In a dramatic turn of events, a potential legal challenge is on the horizon for the UK government, as a rival bidder for the Telegraph seeks to contest a recent government decision. The Telegraph, a prominent British newspaper, has been in a state of uncertainty for three years, ever since the Barclay family lost control due to substantial unpaid debts. The latest development involves a legal strategy being considered by those involved in a competing bid, led by Dovid Efune, the British owner of the New York Sun.
The government's decision to allow the Daily Mail owner, Lord Rothermere, to take a significant step towards a £500 million takeover has sparked controversy. This decision comes after the culture secretary, Lisa Nandy, lifted restrictions that had previously hindered the Daily Mail and General Trust (DMGT) from acquiring the option to purchase the Telegraph. The Telegraph's titles, including the daily and Sunday editions, have been up for grabs since the Barclay family's departure.
The current option holder, RedBird IMI, an Abu Dhabi-backed venture, has been forced to sell the Telegraph titles due to a legal change preventing excessive overseas state ownership of newspaper groups. However, Efune's consortium is now exploring a potential judicial review of the government's decision, fearing it could prejudice the ongoing regulatory investigations into the Telegraph's sale to Rothermere's group. These investigations are scrutinizing the deal's impact on media plurality and competition.
One of the key concerns is that Rothermere's bid could be blocked, and if so, the option to own the Telegraph would effectively place DMGT in charge of its sale. This scenario raises questions about which rival bids would be accepted, giving DMGT significant control over the process. The consortium's spokesperson remained silent on the matter.
DMGT's deal to buy the Telegraph titles was finalized in November, establishing an exclusive period with RedBird IMI. Critics have also raised eyebrows over DMGT's move last October to relocate the group's lucrative events business, primarily based in Qatar and Saudi Arabia, to a new offshore parent company, Rothermere Continuation Holdings Ltd. This reorganization occurred before the Telegraph's return to the market.
DMGT assured that there would be no state funding in its Telegraph deal, emphasizing the laws limiting state ownership are designed to prevent overseas states from directly or indirectly controlling or influencing UK newspapers. However, concerns have been raised about the consolidation of 'right-leaning' titles and the potential alignment of editorial positions between the Mail and Telegraph, with the regulator Ofcom set to examine the deal's impact on media plurality.
